Concern for loss of Scots HMRC crime unit

Commenting on articles in the Sunday Express and Sunday Herald, North East Scotland SNP MSP Nigel Don, a member of the Scottish Parliament's Justice Committee, has expressed concern about the proposed merger of Her Majesty's Revenue and Customs (HMRC) Scottish criminal investigation unit with the unit in the east of England.

Merging Scotland's unit with the east of England raises questions about the recognition of the Scottish legal system, as the powers available in England under the Police and Criminal Evidence Act do not apply in Scotland, which has its own powers.

Commenting Mr Don said:

"While co-operation between the different parts of the HMRC's Criminal Investigation Directorate is of course to be encouraged, it is questionable whether merging Scotland's Directorate with the east of England is the way to achieve it.

"Most importantly, any changes to the current set up must recognise the independence of the Scottish legal system.

"Those working within the Scottish Criminal Investigation Directorate deal with a different system of courts and prosecution service than other parts of the UK.

"It is crucial that the organisation of the HMRC accommodates the distinct nature of Scots Law."
