Landmark Rape Ruling - A Common Sense Decision

Ms Roseanna Cunningham MSP, SNP Shadow Justice Minister, has today (Friday) welcomed the ruling by seven of Scotland’s senior judges which redefines the legal meaning of the term rape so that the absence of consent, rather than the use of force, should determine whether a rape had been committed. Ms Cunningham said:

“This common sense decision represents a very necessary re-definition of the law regarding rape to take account of society’s attitudes in the 21st century.

“Social attitudes change, they move on, and the law has to reflect what society at large think is appropriate.

“No must mean no and now the law recognises that. Today’s announcement sends out a very positive message in that regard.”
